By accessing or using ClassPodia, you agree that:

• You have read, understood, and agree to be bound by these Terms
• You comply with all applicable laws and regulations
• If you are under 18, you have obtained parental or guardian consent
• You are legally capable of entering into binding contracts

If you do not agree to these Terms, you may not use ClassPodia.

2.1 Account Types

ClassPodia offers different account types:

• Student Accounts: For individuals seeking tutoring services
• Parent Accounts: For parents/guardians managing their children's learning
• Tutor Accounts: For qualified individuals providing tutoring services

2.2 Account Requirements

You must:

• Provide accurate, complete, and current information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Not share your account with others
• Not create multiple accounts without permission
• Update your information promptly when it changes

2.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms or our Community Guidelines
• Engage in fraudulent, abusive, or illegal activities
• Provide false or misleading information
• Fail to pay for services rendered
• Damage our reputation or platform integrity

3.1 Tutor Verification

To become a verified tutor, you must:

• Submit valid credentials and qualifications
• Undergo background checks and identity verification
• Provide accurate information about your teaching experience
• Maintain active and valid credentials throughout your tenure

3.2 Tutor Responsibilities

As a tutor, you agree to:

• Provide quality educational services to the best of your ability
• Conduct yourself professionally and ethically
• Arrive on time for scheduled lessons
• Respect student privacy and confidentiality
• Not discriminate based on race, religion, gender, or other protected characteristics
• Maintain appropriate boundaries with students
• Report any safety concerns immediately

3.3 Pricing and Payments

• You set your own hourly rates
• ClassPodia charges a platform fee on each completed lesson
• Payments are processed through our payment partners
• Earnings are transferred to your account according to our payment schedule
• You are responsible for reporting and paying taxes on your earnings

3.4 Independent Contractor Status

Tutors are independent contractors, not employees of ClassPodia. You are responsible for your own taxes, insurance, and business expenses. ClassPodia does not provide employee benefits.

4.1 Booking and Scheduling

• You must book lessons through the ClassPodia platform
• Lesson times are subject to tutor availability
• You must attend scheduled lessons or cancel with appropriate notice
• Late cancellations may result in fees

4.2 Payment Terms

• Payment is required at the time of booking
• All fees are in Nigerian Naira (₦) unless otherwise stated
• Payments are non-refundable except as provided in our Refund Policy
• You authorize ClassPodia to charge your payment method

4.3 Cancellation and Refund Policy

• 24+ hours before lesson: Full refund
• 12-24 hours before lesson: 50% refund
• Less than 12 hours: No refund
• Tutor cancellation: Full refund
• Technical issues: Case-by-case basis

4.4 Student Conduct

Students and parents agree to:

• Treat tutors with respect and professionalism
• Arrive on time for scheduled lessons
• Provide a conducive learning environment
• Not engage in harassment, abuse, or inappropriate behavior
• Not record lessons without tutor consent

5.1 Permitted Use

You may use ClassPodia only for:

• Finding or providing legitimate tutoring services
• Communicating with other users through our platform
• Accessing educational resources and support materials

5.2 Prohibited Activities

You may NOT:

• Circumvent the platform to arrange direct payments or services
• Use the platform for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Post false, inaccurate, misleading, or defamatory content
• Harass, abuse, threaten, or intimidate other users
• Upload viruses, malware, or harmful code
• Scrape, crawl, or use automated tools to access the platform
• Impersonate others or misrepresent your identity
• Interfere with platform security or operations
• Reverse engineer or attempt to extract source code

6.1 ClassPodia Content

All content on ClassPodia, including but not limited to text, graphics, logos, images, software, and design, is the property of ClassPodia or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

By posting content on ClassPodia, you grant us:

• A worldwide, non-exclusive, royalty-free license to use, display, and distribute your content
• The right to use your name, image, and likeness in connection with your content
• Permission to sublicense these rights to our service providers

6.3 Copyright Infringement

If you believe content on ClassPodia infringes your copyright, please contact us at legal@classpodia.com with:

• Identification of the copyrighted work
• Location of the infringing material
• Your contact information
• A statement of good faith belief
• Your signature (physical or electronic)

7.1 Service Disclaimer

ClassPodia is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy, reliability, or quality of tutoring services
• Uninterrupted or error-free platform operation
• Security of your data or communications
• Results or outcomes from using our services

7.2 Third-Party Disclaimer

ClassPodia is a platform connecting students and tutors. We do not:

• Employ or supervise tutors
• Guarantee the quality, accuracy, or legality of tutor services
• Guarantee specific educational outcomes or results
• Endorse any specific tutor or student

7.3 Background Check Disclaimer

While we conduct background checks on tutors, we cannot guarantee their completeness or accuracy. Parents should exercise their own judgment and due diligence.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLASSPODIA SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Actions or omissions of tutors, students, or other users
• Unauthorized access to or alteration of your data
• Errors, mistakes, or inaccuracies in content
• Service interruptions or delays

Our total liability to you for any claims arising from your use of ClassPodia shall not exceed the amount you paid us in the 12 months preceding the claim, or ₦50,000, whichever is less.

You agree to indemnify, defend, and hold harmless ClassPodia, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the platform
• Your violation of any rights of another user or third party
• Your content or conduct on the platform
• Your provision or receipt of tutoring services

10.1 Informal Resolution

Before initiating any legal proceeding, you agree to first contact us at disputes@classpodia.com to attempt to resolve the dispute informally.

10.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

10.3 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Lagos State, Nigeria, and you consent to the jurisdiction of such courts.

11.1 Changes to Terms

We may modify these Terms at any time. When we do, we will:

• Update the "Last Updated" date
• Notify you via email or platform notification
• Provide you an opportunity to review changes before they take effect

Your continued use of ClassPodia after changes take effect constitutes acceptance of the modified Terms.

11.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

11.3 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ClassPodia regarding the use of our platform.

11.4 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

11.5 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
